By accessing and using the KushNation Cannabis Social Club Platform ("the Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. Cannabis use is subject to strict legal requirements in South Africa. Violation of these terms may result in immediate account suspension or permanent removal, pending the outcome of a review process.
1. Acceptance of Terms
These Terms and Conditions govern your use of the KushNation Cannabis Social Club Platform and all associated services. By registering as a member or accessing the Platform, you agree to comply with these terms and all applicable South African laws and regulations.
If you do not agree with any part of these terms, you must not use the Platform or participate in any cannabis social club activities.
2. Applicable Legislation
📜 Governing South African Laws
The use of cannabis in South Africa is governed by the following legislation:
- Constitutional Court Judgment in Minister of Justice and Constitutional Development v Prince (CCT 108/17) [2018] ZACC 30 - Decriminalised the private adult use and cultivation of cannabis for personal consumption in private spaces.
- Cannabis for Private Purposes Act, 2023 (Act No. 4 of 2023) - Provides the legal framework for the lawful use and cultivation of cannabis by adults in private for personal consumption.
- Drugs and Drug Trafficking Act, 1992 (Act No. 140 of 1992) - Continues to regulate cannabis as a controlled substance, with specific exemptions for private personal use.
- Medicines and Related Substances Control Act, 1965 (Act No. 101 of 1965) - Regulates medicinal cannabis products and related substances.
All members and clubs on the Platform must operate strictly within the boundaries established by these laws.
3. Legal Requirements for Cannabis Use
3.1 Private Use Only
Cannabis use and cultivation through the Platform is strictly limited to private, personal consumption by adults (18 years and older) in accordance with South African law. The following activities are permitted:
- Use of cannabis by adults in private residences or designated private spaces
- Cultivation of cannabis plants for personal use in private
- Possession of cannabis in private for personal consumption
- Sharing of cannabis products among adults in private social club settings
3.2 Prohibited Activities
The following activities are strictly prohibited and constitute serious violations of these Terms:
- Sale or commercial trade of cannabis products - The Platform facilitates social clubs only, not commercial enterprises
- Public consumption - Cannabis may not be used in public spaces or any location accessible to the general public
- Supply to minors - Providing cannabis to anyone under 18 years of age is illegal and will result in immediate account termination and reporting to authorities
- Distribution for profit - Any form of commercial distribution is prohibited
- Use in the presence of minors - Cannabis use where children are present is prohibited
- Export or transport across borders - Moving cannabis products across provincial or international borders
- Driving under the influence - Operating any vehicle while impaired by cannabis
3.3 Quantity Limitations
Members must comply with legal possession limits as established by South African law:
- Personal cultivation limited to quantities for personal use only
- Possession amounts must be reasonable and consistent with personal consumption
- Social clubs must maintain accurate records of product distribution to members
4. Membership Requirements
4.1 Age Verification
All members must be 18 years of age or older. The Platform requires:
- Valid South African ID verification during registration
- Proof of age documentation
- Accurate personal information
Providing false information or documentation is grounds for immediate account termination and may constitute fraud.
4.2 Member Responsibilities
As a member, you agree to:
- Use cannabis responsibly and in accordance with all applicable laws
- Keep your membership credentials confidential and secure
- Notify the Platform immediately of any unauthorised use of your account
- Participate only in activities permitted under South African law
- Respect the privacy and rights of other members
- Not share, sell, or transfer your membership to others
4.3 Medical Cannabis Members
Members using cannabis for medical purposes must:
- Provide valid medical documentation from a registered healthcare practitioner
- Update medical documentation as required
- Use cannabis strictly in accordance with medical recommendations
- Comply with all provisions of the Medicines and Related Substances Control Act
5. Social Club Operations
5.1 Club Registration
Cannabis social clubs using the Platform must:
- Operate as non-profit, member-based organisations
- Maintain a private, members-only facility
- Verify the age and identity of all members
- Keep accurate records of all cannabis products and member transactions
- Ensure all activities occur in private spaces not accessible to the public
- Comply with all local municipal regulations and by-laws
5.2 Product Traceability
All cannabis products distributed through social clubs must:
- Be tracked from cultivation/supplier to member
- Include batch numbers for quality and safety tracking
- Be tested for safety and potency where required
- Not be sourced from illegal suppliers or criminal organisations
5.3 Record Keeping
Clubs must maintain detailed records including:
- Member registration and verification documents
- Product inventory and distribution logs
- Supplier information and product sources
- Transaction histories
These records may be required for legal compliance audits and must be retained for a minimum of 5 years.
6. Responsible Use Guidelines
6.1 Health and Safety
Members are responsible for:
- Understanding the effects and risks of cannabis use
- Using cannabis in moderation and responsibly
- Not operating vehicles or machinery while impaired
- Seeking medical advice before use if pregnant, nursing, or on medication
- Storing cannabis products securely away from children and pets
6.2 Workplace and Public Safety
Members must not:
- Use cannabis in the workplace or before/during work hours if it may impair performance
- Attend work impaired by cannabis
- Use cannabis in any situation where it may endanger others
- Transport cannabis in vehicles in a manner that violates traffic laws
6.3 Harm Reduction
The Platform promotes harm reduction practices including:
- Education about safe consumption methods
- Information about dosage and potency
- Resources for members experiencing adverse effects
- Support for members who may develop problematic use patterns
7. Privacy and Data Protection
7.1 Personal Information
The Platform collects and processes personal information in compliance with the Protection of Personal Information Act (POPIA), 2013. This includes:
- Identity verification documents
- Contact information
- Transaction histories
- Medical documentation (for medical members)
7.2 Data Security
We implement industry-standard security measures to protect your personal information. However, members acknowledge that no system is completely secure and use the Platform at their own risk.
7.3 Data Sharing
Personal information will only be shared:
- With explicit member consent
- As required by law or court order
- With regulatory authorities for compliance purposes
- To prevent illegal activities or protect public safety
⚠️ Violations and Enforcement
8.1 Violation Categories
Minor Violations:
- Failure to update membership information
- Late submission of required documentation
- Minor record-keeping errors
Action: Written warning and requirement to remedy within 14 days.
Serious Violations:
- Possession amounts exceeding personal use limits
- Use in semi-public or inappropriate locations
- Failure to verify member ages properly
- Inadequate product tracking or record keeping
Action: Immediate account suspension pending investigation.
Critical Violations:
- Sale or commercial distribution of cannabis
- Providing cannabis to minors
- Operating outside private premises
- Sourcing from illegal suppliers
- Providing false information or documentation
- Any activity that violates South African criminal law
Action: Immediate permanent account termination and reporting to relevant authorities.
8.2 Review Process
Members or clubs facing suspension or termination are entitled to:
- Written notification of the alleged violation
- Opportunity to respond within 7 days
- Review by Platform administrators
- Final decision within 21 days of initial notification
8.3 Appeals
Decisions may be appealed within 14 days of notification. Appeals must be submitted in writing with supporting evidence. The Platform's decision on appeals is final.
8.4 Legal Consequences
Members acknowledge that violations of these Terms may also constitute criminal offenses under South African law, punishable by fines and/or imprisonment. The Platform reserves the right to report suspected criminal activity to law enforcement authorities.
9. Limitation of Liability
The Platform provides technology and administrative services only. We do not:
- Cultivate, manufacture, or distribute cannabis products
- Guarantee the quality, safety, or legality of products obtained through clubs
- Assume responsibility for member actions or club operations
- Provide legal or medical advice
Members and clubs use the Platform at their own risk and are solely responsible for ensuring their activities comply with all applicable laws.
10. Indemnification
You agree to indemnify, defend, and hold harmless KushNation, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your violation of these Terms and Conditions
- Your violation of any applicable laws or regulations
- Your use of cannabis products
- Your operation of a social club
- Any claims by third parties related to your activities
11. Modifications to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be:
- Posted on the Platform with a new effective date
- Communicated to members via email
- Effective 30 days after notification
Continued use of the Platform after changes take effect constitutes acceptance of the modified terms.
12. Termination
12.1 By Members
Members may terminate their accounts at any time by written notification to their social club and the Platform.
12.2 By Platform
We reserve the right to terminate or suspend any account immediately, without prior notice, for:
- Violation of these Terms and Conditions
- Violation of applicable laws
- Fraudulent or illegal activity
- Risk to public safety or Platform integrity
13. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of the Republic of South Africa. Any disputes arising from these terms or use of the Platform shall be subject to the exclusive jurisdiction of the courts of South Africa.
